Cash bond only cases are different than any other type of traffic ticket that goes into warrant. First, the meaning of “cash bond only” is a term used to refer to a warrant that can only be removed or lifted if the cash amount of the fine is posted. For example if your fine is $350.00 you would be required to post that amount of money with the court to get a new court date to resolve your ticket. Most people do not choose to do this because it is time consuming. They would rather pay the fine. However, if you “just pay” the fine then you are admitting to guilt and the traffic ticket is reported on your permanent driving record. Certain convictions can cause serious financial penalties and the suspension of a person’s driver’s license.

How Does A Case Become Cash Bond Only?

The easy answer is that someone had to mess up on the case for it to become cash bond only. Normally that “someone” had to have been an attorney. There are two different ways to post bond for a warrant for traffic tickets. First, you can hire an attorney to post a “surety bond” on your behalf. That bond is the attorney’s promise to come to court and resolve the ticket on your behalf. The second way is by cash bond. You can post a cash bond by yourself if you choose not to use an attorney. If the court is requiring cash bond only, it means that you hired an attorney to post a surety bond and they then missed a scheduled court date on your behalf. This is the only way a case can become cash bond only. So, you need to contact the attorney you hired in the first place and see why it is that they missed your court date or did not request a court date on your behalf to resolve the ticket. Further, you should request a refund.

What If I Never Hired An Attorney?

If you never hired an attorney the court cannot require you to post a cash bond. Many courts have lied to people stating that their case is cash bond only in an attempt to get the money in and make the court more profitable. If you have a court that is trying to do this to you, please contact an attorney immediately. You are being taken advantage of by a court system that is meant to protect you. You may also want to consider contacting the State Commission on Judicial Conduct to file a complaint against that judge for manipulating the system to try to make a profit.
